Police Crackdown on Motorists

From February 1, 2025, the Nigeria Police officially commenced the enforcement of the long-existing but often-ignored Third-Party Motor Insurance law. Across the country, motorists found themselves pulled over at checkpoints, their documents scrutinized like never before. But instead of widespread compliance, the move sparked heated debates, confusion, and even resistance.

Many Nigerians questioned the timing. Why now, after decades of lax enforcement? Others raised concerns over the role of the police, arguing that such enforcement should fall under the jurisdiction of the Federal Road Safety Corps (FRSC). The already fragile trust in law enforcement, worsened by past experiences of extortion, made the initiative feel more like another revenue drive than a genuine effort to protect citizens.

Some drivers, unaware of the actual benefits of third-party insurance, saw it as just another government-imposed levy. Others just like Kunle, who had comprehensive insurance, found themselves baffled when some officers rejected their policies, insisting only third-party coverage was valid under the law. Third-party motor insurance is the most basic and legally required form of vehicle insurance in Nigeria. It is designed to provide financial protection for others, when the policyholder is at fault in an accident. The key areas of coverage include:

  1. Property Damage to Third Parties: If you hit another car, damage a building, or destroy public infrastructure like streetlights or traffic signs, your insurance covers the cost of repairs or replacement.
  2. Injury or Death of Third Parties: If an accident causes injury or death to another road user whether a pedestrian, passenger, or another driver, third-party insurance covers medical expenses, legal fees, and compensation to the third party or their beneficiaries.
  3. Legal Liability: In cases where an accident results in a lawsuit, third-party insurance covers legal costs and compensation that may be awarded to the injured party.

In Nigeria, the minimum compensation limit for third-party motor insurance is 3 million for property damage and unlimited liability for injury or death. This means that for just 15,000 annually, motorists are financially protected against potentially devastating claims.

Why Every Motorist Needs Third-Party Insurance

Many drivers do not realize the financial disaster they could face if they cause an accident without insurance. A single claim could run into millions, leading to lawsuits, asset seizures, or even imprisonment for those unable to pay damages.

    Are we to have a seperate Third Party Policy along side Comprehensive Motor Insurance Policy?

      2) You don’t need a separate third-party cover if you have comprehensive insurance. Your comprehensive insurance policy already provides third party coverage. The law mandates a minimum of third-party cover to protect other road users in case of an accident.

      If you’re involved in an accident with third-party insurance, follow these steps:
      1) At the Scene:
      * Stay calm & ensure safety.
      * Don’t admit fault if you are not sure of who is at fault – Let the insurance and Police decide.
      * Call to inform your insurer of the accident for necessary support and guidance
      * Gather evidence – Take photos/videos of the scene, damages, number plates, and injuries if any.
      * Collect information – Collect copy of insurance certificate, copy of vehicle particulars and contact details of the other driver and get witness statements where possible.
      * Report to the police – Get a police report if there are injuries or significant damage.

      2) Other steps to take After Leaving the scene of the accident:
      * Notify your insurer – Report the accident immediately.
      * Submit documents – Provide the police report, photos, and any other requested documents.
      * Follow up – Your insurer will handle the claim and compensate the third party.

      Benefits of third-party insurance cover:
      * Covers other vehicle/property damages

    Thank you for the encouragement. I had thought that the comprehensive insurance also covers (inclusive of) third party damage (s) while the third party insurance is only restricted to third party as the name implies.
